Notarised Rent Agreement in Siliguri

Short version

A notarised rent agreement is a lease both sides sign, which a notary at Hill Cart Road attests. Notarisation is not registration at the sub-registrar. A lease of immovable property from year to year, or for any term exceeding one year, generally has to be registered. Do not treat a shorter deed as a way to avoid that rule.

What people in Siliguri use it for

Landlords and tenants around Hill Cart Road, Pradhan Nagar and the college belts use a written rent agreement for a house, a flat or a shop. Banks and the police sometimes ask the tenant for it as address support. The agreement records rent, the term, and who pays which bill.

A notary attestation shows that the people signed before the notary. It does not, by itself, register the lease.

Notarisation and registration are different

The notary's act is under the Notaries Act, 1952. The lease itself is a contract, and for immovable property the Transfer of Property Act, 1882 and the Registration Act, 1908 matter. Under the Registration Act, leases of immovable property from year to year, or for any term exceeding one year, or reserving a yearly rent, generally require registration. An unregistered lease that needed registration is weak evidence of the term.

You should not shorten the writing to avoid registration when you both intend a longer stay. If the real arrangement is longer, the paper should say so, and registration should be discussed. Stamp duty is fixed by West Bengal rules and changes. Notarisation at this chamber starts at Rupees 100. Stamp paper, when your paper needs it, is extra and follows the West Bengal rate in force that week. Send the details on WhatsApp and we'll reply with the exact cost. Stamp duty follows the West Bengal rules for the term you actually agree.

Who should come, and with what

Both the landlord and the tenant should attend if both are signing.

Landlord

  • Identity card
  • Paper showing you can let the place, such as a deed or a tax receipt, if you have it
  • The rent and the deposit you have actually agreed

Tenant

  • Identity card
  • The address you want written
  • Any society rule you were told to follow

Which case is yours?

Find the row that matches your papers. The first step is yours. The last column is the office that still has to accept the paper.

First 24 hours

Agree the rent, deposit, term, and notice period before you come. Both the landlord and the tenant should attend if both will sign.

Notarisation shows that you signed at the chamber. It is not registration. A lease of immovable property for a term exceeding one year generally has to be registered.

Steps

The chamber is at the PNB building, Hill Cart Road, opposite Meghdoot Cinema Hall.

  1. Agree the commercial terms first We write the rent, deposit, term and notice period you both state. We do not invent a rent to suit a bank.
  2. Sign before the notary Identity is checked. A signature sent on a scan is not the same as appearing, unless a law expressly allows that for the paper in front of us. For a lease, come in person.
  3. Ask about registration If the term exceeds one year, we will tell you that registration is a separate step at the sub-registrar, not a second notary stamp.

When you know which row matches your papers, call or send them on WhatsApp.

Clauses that hurt later

A deposit with no mention of when it comes back, a repair duty dumped entirely on one side, and a lock-in that neither person understood, are the usual regrets. Also, naming a person as landlord when only a relative owns the house creates a false paper.

You should not use a notarised page to pretend a long lease was never meant to be registered.

Limits

The notary does not evict a tenant, collect rent, or decide a fair rent. Those are civil matters if a dispute starts. There is no universal cooling-off period. Once both have signed, changing a term means a fresh writing or a signed addendum. Police verification of a tenant, where a local rule asks for it, is not done by the notary.

Why a drafted agreement is better than a borrowed form

Forms copied from another city leave the wrong court, the wrong notice period, or a blank stamp assumption. A short agreement that names the flat, the rent and the term is easier to live with. Send the details on WhatsApp and we'll reply with the exact cost before you print ten copies.

Money between neighbours

Many of these agreements are between people who already know each other. That is why terms get left unsaid. Writing the deposit and the month of exit protects the friendship more than a vague page does. If you have not agreed the rent yet, agree it before you come.

How we help

We draft and notarise. Registration, if needed, is a further step we can explain.

  • Draft the rent, term, deposit and notice
  • Check identity of the people who sign
  • Attest the agreement as Notary Public
  • Say clearly if the term means registration should be considered
  • Tell you to send the details on WhatsApp and we'll reply with the exact cost

Questions people ask

How much does a notarised rent agreement cost?

Notarisation at this chamber starts at Rupees 100. Stamp paper, when your paper needs it, is extra and follows the West Bengal rate in force that week. Send the details on WhatsApp and we'll reply with the exact cost.

How long does it take?

If both people come with identity and the rent is already agreed, drafting and attestation are often one visit. Registration at the sub-registrar is extra time.

Is notarisation the same as registration?

No. Registration is before the sub-registrar under the Registration Act. A notary stamp does not replace it.

Should I make it eleven months?

Only if eleven months is the real term. Do not shorten the writing to dodge registration while you both intend a longer stay.

Can the tenant come alone?

Not if the landlord must sign. A signature taken elsewhere, without the notary seeing it, is not how this chamber attests a lease.

Does this prove the tenant's address?

It is often accepted as support. The bank or Aadhaar centre can still ask for more.

Who keeps the original?

Decide that in the agreement. Usually each side keeps a signed copy. If you also want the chamber to hold a copy, send the details on WhatsApp and we'll reply with the exact cost.
