Power of Attorney Attestation in Siliguri
A power of attorney lets a named person act for you, for a bank, a case, or a property step. The person giving the power, called the principal, should appear at the Hill Cart Road notary. A power to sell or deal with immovable property often has to be registered. Notary attestation alone may not be enough for that.
Why a power of attorney is made
People ask for this when they live outside Siliguri, when they are unwell, or when a son or daughter will collect papers, meet a bank, or attend a mutation queue. The attorney can do only what the writing allows. A wide 'general' power is not a small favour. Read it.
The notary checks that you are the person giving the power and that you signed. The notary does not promise that the attorney will be honest.
Notary stamp and registration
Attestation is under the Notaries Act, 1952. The power is also read with the Powers of Attorney Act, 1882. Where the power authorises a person to present a document for registration, or to sell, mortgage or otherwise deal with immovable property, the Registration Act, 1908 often requires the power itself to be registered. A notary stamp is not that registration.
We will tell you if the job you described usually needs the sub-registrar. A power to sell property is not finished by a notary stamp when registration is required. Stamp duty depends on the state rules and the kind of power. Notarisation at this chamber starts at Rupees 100. Stamp paper, when your paper needs it, is extra and follows the West Bengal rate in force that week. Send the details on WhatsApp and we'll reply with the exact cost.
What the principal should bring
The attorney need not always attend. The principal must.
Identity and purpose
- The principal's photo identity
- The attorney's name, address and identity details
- A short note of the exact acts you want done
- Property papers only if the power is about that property
If you are abroad
- Do not assume a local notary in India can attest a signature made in another country
- Ask whether that country wants a consular step or an apostille
- Send the details on WhatsApp and we'll reply with the exact cost before anyone travels
Which case is yours?
Find the row that matches your papers. The first step is yours. The last column is the office that still has to accept the paper.
| Your situation | What you do first | Who else is involved |
|---|---|---|
| Someone will meet a bank or collect papers | Limit the power to that bank or that errand | The bank or office that will see the power |
| Someone will deal with land or a flat | Ask about registration before you rely on a notary stamp alone | The sub-registrar |
| You want to cancel a power you already gave | That is a separate writing, and the people who hold the old power should be told | The attorney and any bank or registry that was given the old power |
First 24 hours
Write one sentence about what the attorney may do. Collecting a letter is not the same as selling a house. The person giving the power, the principal, comes to the chamber.
A power used to sell or present immovable property often has to be registered. The notary stamp is not that registration.
Steps at the chamber
Come to the ground floor, PNB building, Hill Cart Road.
- Limit the acts We list what the attorney may do. Collecting a letter is not the same as selling a house.
- Explain registration If the power is for immovable property, we say whether registration should be the next door you open.
- Sign and identify You sign before the notary. If you do not understand the language, tell us before you sign.
When you know which row matches your papers, call or send them on WhatsApp.
Risks
A general power handed to a relative has been misused in property matters across India. Give the narrowest power that does the job, and for a period you can watch. Do not sign a power that lets someone sell land if you only wanted a bank KYC done.
A power does not survive every situation. Death of the principal generally ends it. A company or a court may still refuse a power that is not in their format.
Limits, including cancellation
Revoking a power is a separate writing, and people who were relying on it should be told. The notary does not automatically inform the land registry or the bank. There is no single limitation period for making a power, but a bank's deadline will not pause. We cannot notarise a power for a principal who is not present and not identifiable.
Why the scope should be drafted carefully
Printed powers with twenty unchecked boxes get used for the box you never meant. A one-page power that names the bank, or the case number, or the plot, is safer. Send the details on WhatsApp and we'll reply with the exact cost and say what the attorney must do, in one sentence.
Trust, written down
People hesitate because the power feels like giving the house away. It can be limited. Tell us the worry. If you are being pressed by someone else to sign today, you can wait. A notary visit is not an emergency unless you say it is.

- Attest under the notary seal
- Flag registration where the power concerns immovable property
- Ask you to send the details on WhatsApp and we'll reply with the exact cost
Questions people ask
How much does power of attorney attestation cost?
Notarisation at this chamber starts at Rupees 100. Stamp paper, when your paper needs it, is extra and follows the West Bengal rate in force that week. Send the details on WhatsApp and we'll reply with the exact cost.
How long does it take?
A narrow power, with the principal present, is often one visit. Registration of a property power takes a separate appointment at the sub-registrar.
Can my son sign the power for me if I am in hospital?
No. You sign the power yourself. If you cannot travel, send the details on WhatsApp and we'll reply with the exact cost and say whether a visit is possible. A person who cannot understand the paper should not be made to sign.
Is a notarised power enough to sell land?
Often no. Powers used to sell or present immovable property for registration generally need registration. Ask before you rely on a notary stamp alone.
How do I cancel it?
By a written revocation, and by informing the attorney and anyone who was given the power. We can draft that as a separate paper.
Can it be in English?
Yes. If you do not read English, we will explain the acts before you sign. Do not sign on an explanation you did not follow.
Does the attorney have to come?
Usually the principal's presence is the essential one. Bring the attorney's identity details either way.
